1. Vehicle, term and pickup Owner rents the vehicle identified below to Renter for the dates listed. Pickup is by 24/7 contactless lockbox in New Port Richey, Florida, or by delivery to Tampa International (TPA) or St. Pete–Clearwater (PIE) airport for an additional $40 per delivery, as selected. Renter will return the vehicle to the agreed location by the agreed time in the same condition as received, ordinary wear excepted.
4. Age and license verification Renter and each Authorized Driver must be at least the minimum age set by Owner (TBD by owner) and hold a valid, unexpired driver's license for the full rental period. Renter consents to identity, license, and insurance verification as described in our Driver Verification step. Owner may cancel a booking if verification is not completed or does not match.
6. Damage, loss and theft Renter is responsible for all damage to, loss of, or theft of the vehicle, its keys, and accessories during the rental, regardless of fault, including repair costs, diminished value, towing, storage, loss of use while the vehicle is out of service, and reasonable administrative costs, to the extent permitted by Florida law. Renter will photograph the vehicle at pickup and return and share the photos on request.
Initials 7. Tolls, tickets and citations Renter is responsible for all tolls, parking tickets, red-light and speed-camera citations, impound fees, and fines incurred during the rental, plus an administrative fee per item (TBD by owner). Owner may transfer liability for citations to Renter as allowed by Florida law.
8. Fuel Renter will return the vehicle with at least the same fuel level as at pickup. Missing fuel may be charged at cost plus a refuel fee (TBD by owner).
11. Late return Renter will return the vehicle on time. Late returns without Owner's written approval may be charged at the late-return rate set by Owner (TBD by owner), plus any costs caused to the next guest. A vehicle not returned within 24 hours of the due time without contact may be reported to law enforcement.
12. Prohibited uses Renter will not: allow unauthorized drivers; drive under the influence of alcohol or drugs; use the vehicle for rideshare, delivery, or any commercial purpose; tow or push anything; race, perform stunts, or go off-road; carry more passengers than seat belts; transport hazardous materials; drive outside the continental United States; sublease the vehicle; or use it for any illegal purpose. Any prohibited use is a material breach and may void coverage.
13. Indemnification To the fullest extent permitted by law, Renter will defend, indemnify, and hold harmless Owner and its members, employees, and agents from all claims, losses, damages, fines, and expenses (including reasonable attorney fees) arising from Renter's or any driver's use of the vehicle or breach of this Agreement, except to the extent caused by Owner's gross negligence or willful misconduct.
Initials 14. Payment and authorization Renter authorizes Owner, through its payment processor, to charge Renter's payment method for the rental, to place a refundable $150 incidental deposit as an authorization hold, and to charge any amounts owed under this Agreement after the trip, with documentation provided to Renter. The deposit hold is not part of the rental total. It covers incidentals such as tolls, fuel, cleaning, parking tickets and citations, extra miles, late return, and the $150 smoking cleaning fee, and is released after the trip ends and the vehicle is inspected, less any documented amounts owed. Amounts above the deposit may be charged separately.
15. Governing law and venue This Agreement is governed by the laws of the State of Florida. Any dispute will be brought in the state courts located in Pasco County, Florida.
16. Severability and entire agreement If any part of this Agreement is found unenforceable, the rest remains in effect and the unenforceable part will be enforced to the maximum extent allowed. This Agreement, together with the booking confirmation, is the entire agreement between the parties for this rental.
